Mississippi marijuana laws

Mississippi has an operating medical cannabis program but no general adult-use marijuana system.

Possession and use

Mississippi protects only patients with a valid MMCP card and compliant medical cannabis. The program FAQ caps possession at 28 Mississippi Medical Cannabis Equivalency Units (MMCEUs) for a resident cardholder and 14 for a nonresident. One unit is 3.5 grams of flower or one gram of concentrate. Public use and use in a motor vehicle remain prohibited. No general adult-use possession is authorized.

Medical access

Patients need a qualifying condition, practitioner certification and an MMCP card. The program's current FAQ says a nonresident with an active home-state medical card may apply up to 30 days before arrival for a Mississippi card valid 15 days. The visiting card is a separate application, not automatic reciprocity.

A resident may obtain no more than 24 MMCEUs in a 30-day period. A visiting cardholder may be dispensed no more than six MMCEUs per week or twelve in fifteen consecutive days under the program FAQ. These are dispensing ceilings; the separate possession ceiling still applies.

The MMCP says a registered practitioner certifies the condition, then the patient applies within six months for the state card. The state does not publish patient names. Patients should use their electronic identification card at a licensed dispensary and confirm that the purchase will fit both the rolling allotment and possession amount.

Home cultivation

Mississippi's current medical cannabis regulations expressly prohibit home growing. A patient card does not authorize a patient or caregiver to cultivate plants at home.

Buying legally

Medical products should be bought through an MMCP-licensed dispensary after patient registration. MSDH links to the program portal and business search. There is no state-licensed adult-use marijuana storefront pathway under the reviewed sources.

The medical program website has a business search for registered establishments, while the Department of Revenue licenses dispensaries. Local governments were allowed to opt out of certain medical cannabis business activities, so a registered patient should check whether a dispensary is actually operating nearby before planning a visit.

Taxes

The Mississippi Department of Revenue says medical dispensaries charge 7% sales tax to cardholders at the point of sale, with special local levies in Jackson and Tupelo. A 5% excise is imposed on the first sale or transfer from a cultivator. That upstream excise should not be represented as another fixed checkout percentage.

Travel and transport

A Mississippi patient card does not authorize importing cannabis bought elsewhere or taking purchases over a state border. Keep products in lawful in-state channels and avoid impaired driving. Visitors should verify whether any temporary patient registration exists before relying on another state's card.

MMCP's patient FAQ states that medical use in a public place or motor vehicle is not authorized. A nonresident card allows eligible in-state transactions only during its fifteen-day validity. It does not make marijuana purchased in another state lawful Mississippi medical inventory.
