Ohio has operational adult-use and medical cannabis sales. Adults 21 and older may possess limited amounts and grow at home; the medical program has separate eligibility and supply rules.

What still needs checking

  • The DCC FAQ direct-open failed with 404 even though search returned a current crawl. Core possession, home-grow and tax numbers were independently opened in code sections effective March 20, 2026.

Possession and use

Adults 21 or older may possess up to 2.5 ounces of plant material and 15 grams of extract under the Ohio code's current cumulative cap for adult-use and homegrown cannabis. Public consumption is prohibited. The statute also forbids operating a vehicle, boat or aircraft under the influence.

Medical access

Ohio's medical program began sales in January 2019. A patient seeking a medical card starts with a recommendation from an Ohio physician holding a certificate to recommend. Medical and adult-use programs both sit under the Division of Cannabis Control, but patient supply and product rules are distinct.

Home cultivation

An adult-use consumer aged 21 or older may grow six plants at a primary residence, with no more than twelve homegrown plants at that residence in total. Plants must be in a secured enclosed area, inaccessible to under-21s and out of normal public view. The 2026 code excludes certain child-care and transitional facilities and rentals whose agreements prohibit cultivation. It bars sale of homegrown cannabis and hydrocarbon-based home extraction. The cited provisions do not give medical patients a second plant allowance on top of the adult-use residence cap.

Buying cannabis

Licensed nonmedical sales began August 6, 2024. Adults 21 and over can buy from an operational licensed dispensary; the Division provides a current dispensary map. Its cited daily nonmedical purchase ceiling is 2.5 ounces of plant material or 15,000 milligrams of total THC in other products. A medical card is not needed for an adult-use purchase.

Taxes

Nonmedical purchases carry Ohio state and local sales tax plus a 10% cannabis excise tax. The current code directs the post-refund excise balance 64% to general revenue and 36% to a host-community fund. The combined checkout rate depends on the sale location. Medical cannabis is excluded from this adult-use excise provision.

Visitors and travel

Ohio's adult-use purchase route is based on age, not a medical card. Buying cannabis elsewhere and carrying it into Ohio is prohibited by state and federal law, according to the Division. A medical card or legal adult-use purchase in another state does not authorize interstate transport; use the Ohio rules after arriving.
