Arizona marijuana laws

Arizona allows adult-use marijuana for people 21 and older, with clear one-ounce and home-grow limits. Its separate medical program offers larger patient allotments. Out-of-state medical cards have limited recognition and do not authorize medical dispensary purchases.

What still needs checking

  • The medical cultivation condition was checked against §§36-2801 and 36-2804.02; individual card eligibility still requires registry confirmation.

Possession and use

A.R.S. §36-2852 protects adults 21 or older possessing, purchasing or transporting up to one ounce of marijuana, with no more than five grams of that amount as concentrate. It also permits gifts within the same limit to another adult without payment or public promotion. This is not a blanket exemption for larger amounts, public smoking or impaired driving.

Arizona's medical and adult-use pathways are distinct. An out-of-state patient can receive recognition for qualifying possession under the medical statute but cannot buy at an Arizona nonprofit medical dispensary on that basis. If the visitor is at least 21, an adult-use purchase is the separate legal route and carries the adult quantity and tax rules. Product form matters: the five-gram concentrate maximum is part of the one-ounce adult possession allowance, not an extra five grams on top.

Medical access

Arizona’s medical registry allows qualifying patients to obtain up to 2.5 ounces in a 14-day period. A valid out-of-state medical card has the same force for a visiting qualifying patient’s possession and use, but the statute expressly excludes obtaining marijuana from a nonprofit medical dispensary. Visitors 21 or older may use adult retail under the separate adult-use rules.

Home growing

An adult may grow at most six plants at a primary residence; a residence with two or more adults has a 12-plant ceiling. The plants must be in a locked enclosed area and not visible from public view. A medical patient’s separate cultivation authority requires the card to state that cultivation is allowed; the medical application permits that designation only if no registered dispensary operates within 25 miles of the patient's home. Do not combine the two regimes without checking eligibility.

Where to buy

Licensed marijuana establishments may sell adult-use products to adults 21 or older. Medical dispensaries serve registered Arizona patients under their own verification system, and an out-of-state card alone does not permit medical purchases. Check license status and daily transaction limits before shopping. The adult one-ounce rule is also the amount an adult may transport under §36-2852.

Taxes and price

Arizona law imposes a 16% excise tax on marijuana sold to adult-use consumers. The statute exempts registered medical transactions from that excise, and marijuana remains subject to transaction privilege tax or use tax. Local retail tax can affect the total. Because those ordinary rates vary, the 16% figure is only one component of an adult-use receipt.

Travel and public places

Keep purchases and possession within the applicable adult or medical limit while in Arizona. The visiting-patient protection is not a shopping pass for medical dispensaries. Federal law and other states’ laws control after crossing a state line; Arizona legalization does not authorize taking cannabis out of state. Never drive while impaired, and check private-property and public-use limits.
