Florida marijuana laws

Florida operates a medical marijuana program for eligible permanent or seasonal residents; it has no general adult-use retail system. The state does not recognize out-of-state medical cards.

What still needs checking

  • No currently enacted adult-use authorization was located in the official medical and statute sources.
  • The 2026 annual report is an agency report; verify a specific patient's live registry order with OMMU before purchasing.

Possession and use

Florida law protects only qualified patients and caregivers acting within the Medical Marijuana Use Registry and physician orders. A medical marijuana treatment center may dispense no more than a 70-day supply of non-smoking product during a 70-day period. Smoking products have a separate 35-day order and four-ounce possession cap unless an approved exception applies. Keep purchased products in their original packaging. The medical framework does not create an adult-use possession amount for visitors without a Florida registration.

Medical access

A patient must be a Florida permanent or seasonal resident, have a qualifying condition certified by a qualified Florida physician, and receive a state registry identification card before buying from a licensed medical marijuana treatment center. Seasonal residency has its own documentation requirement. Florida does not offer reciprocity for out-of-state medical cards, so a visiting patient from another state cannot use that card to purchase. A caregiver needs a separate registration and must follow the program's rules.

Home growing

Florida's medical marijuana authorization does not permit patients to grow cannabis at home. Licensed medical marijuana treatment centers cultivate, process and dispense within a regulated system. A patient card, a physician order or ownership of private property does not replace a cultivation license. The state has no adult-use home-grow allowance. Do not order plants or seeds on the assumption that medical eligibility permits personal cultivation.

Where to buy

Registered patients buy from licensed medical marijuana treatment centers, using an active registry card and physician order. The state's patient site links to approved centers and explains how to check card and order status. A center's advertising or a third-party menu is not proof a patient has remaining authorized supply; the registry controls dispensable amounts. Florida has no licensed recreational store system, and an unregistered visitor cannot convert a foreign card into a Florida purchase.

Taxes and price

Florida's Department of Revenue lists medical marijuana and marijuana delivery devices sold by licensed medical marijuana treatment centers to qualified patients as exempt from sales and use tax. This exemption applies to qualifying medical transactions; it does not authorize a purchase outside the medical system. Other retail items at the same business may have different tax treatment, and product pricing remains set by the seller. No adult-use cannabis excise rate exists to quote for Florida's nonexistent adult market.

Travel and public places

Florida's official medical report warns that cannabis remains illegal to transport across state lines. Do not bring an out-of-state supply into Florida or take a Florida purchase out, even with medical credentials. Avoid public consumption and impaired driving, and retain original packaging while carrying authorized products. Hotels, employers and federal property can impose further restrictions. A Florida medical card does not establish permission in another jurisdiction.
