State guide

Georgia marijuana laws

Georgia's medical cannabis program expanded in July 2026, but adult-use cannabis remains unauthorized. Qualified Georgia patients use a state card and licensed dispensaries.

What still needs checking

  • Older Low THC Oil FAQs predate Act 712 and are not relied on for current limits.
  • Act 712 and the commission FAQ distinguish conditional visitor possession recognition from licensed dispensing, which requires Georgia patient or caregiver registration. An out-of-state card alone does not qualify a visitor for licensed checkout. The Act's separate purchase-exemption wording is explained in the guide and source audit. Authorized medical products are subject to applicable sales and use taxes under §16-12-226; no single local checkout rate is asserted.

Possession and use

Georgia's medical cannabis registry allows qualified cardholders to possess authorized medical products within the state program. The Department of Public Health now describes a limit of up to 12,000 milligrams of THC under the 2026 reforms. Older Low THC Oil pages quote a 20-fluid-ounce oil limit and pre-reform product rules; these should not be treated as the complete current medical framework. A medical card does not protect general adult-use marijuana possession or products obtained outside the authorized chain.

Medical access

Georgia's medical cannabis registry requires a qualifying condition, certification by a Georgia physician and proof of Georgia residency. The 2026 Act 712 reforms expanded products and changed the possession ceiling to 12,000 milligrams of THC in qualifying products. For a visit shorter than 45 days, Georgia conditionally recognizes a valid card from a state allowing the same medical-cannabis possession as Georgia law. That limited recognition does not enroll the visitor in Georgia's registry or qualify the visitor for dispensing by a licensed Georgia seller.

Home growing

Georgia patient registration is not permission to cultivate cannabis. The state uses licensed producers and dispensaries for medical supply. No adult-use home-growing route appears in the current DPH patient guidance or 2026 reform legislation. Do not confuse business production permissions with a patient's card. Because the program changed in 2026, patients contemplating any cultivation should check the current enacted act and DPH rules rather than rely on older Low THC Oil summaries.

Where to buy

Licensed Georgia medical cannabis dispensaries and authorized independent pharmacies dispense to Georgia-registered patients or caregivers. A visitor's out-of-state medical card may receive limited recognition for possession under Georgia law, but it does not qualify the visitor for purchase from those licensed sellers. The separate statute that describes lawful possession and purchase for certain visiting cardholders does not expand the dispensing rule's registered-patient definition. Georgia has no adult-use retail channel.

Taxes and price

Georgia law subjects authorized medical cannabis products to applicable sales and use taxes. State and local rates vary by jurisdiction, so there is no one statewide final checkout rate. Ask a licensed dispensary for its itemized price and check the Department of Revenue's rate for that location. Georgia has no adult-use retail market or adult-use excise rate to apply.

Travel and public places

A valid out-of-state medical card receives only conditional, short-visit recognition under Georgia's medical possession rule; a foreign-card-only visitor is not eligible for licensed Georgia dispensary or pharmacy sales. The recognized product must fit Georgia's medical-product, labeled-container and quantity rules. This visitor rule does not authorize carrying cannabis across a state border. Do not drive impaired or consume in a prohibited place.
