Possession and use
An adult 21 or older may possess up to two ounces of cannabis, 16 grams of extract, or edibles containing up to 800 milligrams THC outside the home. The RLD guide says home possession is unlimited for lawfully held cannabis. Public consumption remains prohibited.
RLD's quick reference separates flower, extract and edible THC ceilings rather than offering a single interchangeable weight. It allows unlimited lawful product at home but sets lower amounts that may be bought or transported at once. A medical patient's much larger 425-unit ceiling belongs to the medical program only.
Medical access
The medical program allows qualifying patients a larger 90-day purchase allotment, shown as 425 units or about 15 ounces of flower in RLD's guide. New Mexico recognizes reciprocal participants from other jurisdictions, but the guide says a visiting patient must register at a dispensary and use product purchased in-state.
A reciprocal participant registers at a New Mexico dispensary and buys within the state. The quick reference does not permit bringing a home-state product into the New Mexico medical program. A patient who exceeds the medical ninety-day purchase allowance may only make further purchases through the adult-use channel if eligible.
Home cultivation
An adult 21 or older may grow up to 12 plants total at a private residence, with no more than six mature, flowering plants. In a household with multiple adults, no more than 12 mature plants may be present. The current state personal-use page does not give one numerical household cap for all immature plants; each adult's 12-total limit still applies.
The Department of Health said New Mexico's former medical personal production licenses were invalidated in June 2021, and adults 21 or older no longer need one to grow within the personal-use limits. Older rule and portal text still mentions those licenses, so do not rely on the former four-mature/12-seedling medical count or add it to adult plants. The reviewed current guidance does not resolve cultivation rights for a registered patient younger than 21.
Buying legally
Buy from a licensed cannabis retailer. Adult purchases are limited to two ounces of cannabis, 16 grams of extract, or 800 milligrams THC in edibles at a time. Patients use a separate medical transaction allotment. Product acquired elsewhere is not treated as a lawful New Mexico purchase.
Taxes
New Mexico's adult-use cannabis excise is 14% from July 1, 2026 through June 30, 2027. Gross receipts tax also applies according to location. Medical cannabis sales are outside the cannabis excise, and the tax department lists a medical GRT deduction.
The 14% cannabis excise applies to taxable adult-use product sales during the July 2026 to June 2027 period. Gross receipts tax is location dependent, so the tax department uses the location where the product is handed to the customer. Medical sales have both an excise exclusion and a separate gross-receipts deduction.
Travel and transport
RLD says both medical and adult-use products must be obtained in-state; there is no reciprocal permission to carry an out-of-state product into New Mexico. Do not consume in a vehicle or drive impaired. Keep cannabis off federal property.
