What still needs checking
- CRC consumer page still displays an older fee formula; 2026 Division of Taxation fee page governs this entry.
Possession and use
Adults 21 and older may possess up to six ounces of cannabis and cannabis products under New Jersey law. This is separate from the smaller amount a dispensary may sell in one transaction. Consumption is subject to smoking and property rules; driving impaired remains prohibited.
New Jersey's six-ounce possession cap should not be confused with the one-ounce equivalent a licensed store may sell in a single transaction. CRC publishes form conversions for concentrate, vape oil and ingestible products. Buying several product types requires considering their combined equivalent, not each category in isolation.
Medical access
A registered New Jersey patient may buy up to the certifying practitioner's authorized amount, with a statutory maximum of three ounces over 30 days. Medical purchases are exempt from state sales tax and use licensed alternative treatment centers.
A patient with a medical card from another state can obtain a nonrenewable six-month New Jersey medical card. The visitor must consult a registered New Jersey practitioner, who enrolls them in the registry, then register with current proof of home-state program participation. The outside card alone does not grant medical checkout privileges. Adults 21 or older may use the separate adult-use retail channel.
Home cultivation
The Cannabis Regulatory Commission states that current law does not authorize it to permit or regulate medicinal home cultivation. The reviewed adult-use guide also provides no personal cultivation right. Do not grow at home on the theory that possession or retail purchase is legal.
Buying legally
Buy adult-use products at a New Jersey licensed dispensary after showing age 21 or older. The CRC says one transaction may include up to one ounce of flower or a specified equivalent, such as four grams of concentrate or 1,000 milligrams THC in ingestibles. Medical transactions use separate patient limits.
Taxes
New Jersey charges 6.625% sales tax on recreational retail transactions. The separate Social Equity Excise Fee is $2.50 per ounce for 2026 and is paid on specified transfers by licensed cultivators; it is not a percentage added at retail checkout. Medicinal cannabis is exempt from retail sales tax.
The 2026 $2.50-per-ounce Social Equity Excise Fee applies to cultivators' specified transfers of recreational cannabis. It is not the older one-third-of-one-percent retail add-on printed on CRC's general consumer page. The Division of Taxation's current fee table should be used if calculating business tax or product costs.
Travel and transport
A legal New Jersey purchase does not authorize taking cannabis to another state. The CRC's adult-use guide specifically warns against carrying a purchase home across a state line. Keep it within New Jersey and avoid federal property.
