What still needs checking
- Out-of-state medical sales are affirmatively established by active rule 560-RICR-10-10-2 §2.11(E)(3) and the Commission's October 2025 compliance bulletin. Rhode Island patient registration itself still requires Rhode Island residency. Visiting patients must match their regulator-issued card to government ID from the issuing jurisdiction.
Possession and use
Adults 21 or older may carry up to one ounce of flower, or its concentrate equivalent, and keep up to ten ounces at home. Cannabis use remains subject to public-place and impaired-driving restrictions. A medical patient should not confuse the adult household storage limit with a medical allotment.
Medical access
Rhode Island's medical program registers residents with qualifying debilitating conditions after written practitioner certification. The Health Department requires proof of Rhode Island residency for a new Rhode Island patient card. Separately, the active cannabis rule permits medical sales to visiting patients who present a valid medical card issued by another U.S. jurisdiction's regulator and government identification matching the card name and issuing jurisdiction.
Home cultivation
Adults 21 or older may grow no more than three mature and three immature plants indoors per dwelling for personal use. The grow must be locked, kept from under-21 access and reasonably concealed from public view, with steps to prevent significant odor escaping. Medical cultivation requires a Commission home-grow certificate and a registered location. A qualified patient may receive up to twelve plant sets, meaning twelve mature and twelve immature plants; an authorized caregiver for multiple patients may receive up to twenty-four sets. No medical grow location may hold more than twenty-four sets in total, including any adult-use plants there, regardless of how many people live or grow there.
Buying cannabis
Licensed Rhode Island dispensaries sell tested cannabis for adult use. The Cannabis Control Commission says adult-use sales began December 1, 2022, and lists licensed compassion centers that sell to adults 21 and older. Compassion centers and hybrid retailers may also serve verified out-of-state medical cardholders under the active rule after an intake form. Buy from the regulated channel rather than treating a gift or unlicensed seller as a retail shop.
Taxes
Adult-use sales carry a 10% state cannabis excise tax, a 3% local cannabis excise tax and ordinary sales and use tax. The Division of Taxation says the cannabis excises do not apply to documented medical sales, though medical retailers still have sales-tax and compassion-center surcharge obligations. This distinction affects patient and adult-use receipts.
Visitors and travel
A visitor who is 21 or older may use the licensed adult-use channel, subject to the same limits and ID checks. A visiting medical patient may instead use the medical channel with a valid regulator-issued card and government ID showing residency in that card's issuing jurisdiction; the retailer must complete its intake process. Rhode Island's rule explicitly prohibits taking medical cannabis across state lines. Buy within Rhode Island and do not take leftovers across a border.
