What still needs checking
- Official adult-use bill histories were directly read on October 23, 2026; HB 1200 and HB 20 did not become law. This is a targeted status check, not certification of every bill in the session.
- Interstate paragraph is cautionary; this pass did not retrieve a Pennsylvania-specific transportation statute.
Possession and use
Pennsylvania's medical law protects qualifying patients within that program; it is not a general adult-use allowance. The 2026 governor's budget proposed legalization, but the General Assembly bill records do not show enactment: HB 1200 passed the House in May 2025 and failed a Senate committee motion later that month; HB 20 remained referred to House Health as of October 23, 2026. These proposals do not authorize adult possession or retail sales.
Medical access
Patients register with the Department of Health, obtain certification from an approved practitioner, pay or qualify for assistance with the card fee, and present the Pennsylvania card at a dispensary. Applicants must show Pennsylvania residency with a Pennsylvania driver's license or state ID. The program allows an authorized caregiver for certain patients.
Home cultivation
Patient registration does not authorize a home grow. Pennsylvania's Department of Agriculture explains that medical cannabis is grown through permitted grower-processors or specially permitted hemp growers under the medical law. Do not treat personal hemp cultivation rules as a medical marijuana home-grow exception.
Buying cannabis
A Pennsylvania medical card is needed to purchase from a state-authorized dispensary. The patient page instructs cardholders to visit a Pennsylvania dispensary after registration and certification. There is no supported adult-use retail route in the cited material, and out-of-state medical cards do not satisfy the residency and Pennsylvania-card requirements described by the Department.
Taxes
The Department of Revenue imposes a 5% excise tax on a grower-processor's gross receipts when selling medical marijuana to a dispensary. Medical marijuana itself is not subject to Pennsylvania sales tax, while accessories may be. The 5% is a business-level tax and should not be described as a 5% patient checkout surcharge.
Visitors and travel
Pennsylvania's enrollment page requires state residency and Pennsylvania identification, so a visitor cannot rely on an out-of-state card for a Pennsylvania medical purchase under this program. Medical eligibility does not make interstate carriage lawful. A visitor should not bring cannabis across a state line and should not infer permission from another state's rules.
