What still needs checking
- The official 2022 medical-cannabis tax explanation and current DOR 4.2% rate were directly read; no newer cannabis-specific exemption or excise publication was identified. Confirm any later legal change before publication.
- No official current adult-use status summary was located; negative statement is limited to reviewed program sources.
Possession and use
A qualified medical cardholder's baseline allowable amount is three ounces or less of cannabis, with product-specific quantities subject to Health Department rules. If the card allows cultivation, harvest from permitted plants may be kept at the cultivation property under the statutory definition. These patient rights are not an adult-use allowance.
Medical access
The Department of Health administers a patient registry for debilitating medical conditions after a practitioner certification. It issues an identification card after application and fee processing. A nonresident cardholder must meet the law's conditions and receive South Dakota confirmation of registration; simply showing another state's card is not enough.
Home cultivation
A medical cardholder may grow two flowering and two nonflowering plants only if the registry card specifically authorizes cultivation. The applicant must submit a grow-space diagram, photos and the required fee, and the approved grow must be enclosed and locked. Two authorized cardholders living in the same dwelling may share that locked space. The cited law does not state a universal dwelling-wide plant number; each authorization and caregiver designation still controls.
Buying cannabis
Registered patients may purchase through regulated South Dakota medical establishments. The Health Department says any sale or purchase outside the regulated system is illegal. There is no supported general adult-use retail path in the program information reviewed.
Taxes
The Department of Revenue says retail medical cannabis is subject to sales tax rather than the prescription-drug exemption. Its 2022 medical-cannabis notice used a then-current 4.5% state rate; that figure is stale. The Department's current general state sales and use tax rate is 4.2%, and a municipality may add up to 2% general sales tax. Check the city rate for a particular purchase; no separate cannabis excise rate was verified.
Visitors and travel
South Dakota recognizes a defined nonresident cardholder process involving an existing card, debilitating condition and confirmation from its Department of Health. That is an in-state access rule, not authority to move cannabis across a state border. Visitors should complete South Dakota's process and buy from its regulated channel.
