Tennessee marijuana laws

Tennessee continues to prohibit marijuana. State hemp and limited cannabidiol rules should not be mistaken for an operational medical cannabis dispensary program.

What still needs checking

  • The 2024 commission account was reconciled with 2026 enacted Public Chapter 789 and the medical-program proposal HB 0872/SB 0489. The enacted chapter did not establish patient dispensing; the proposal failed or stalled. This targeted check does not certify every 2026 cannabis-related statute.

Possession and use

The Tennessee Bureau of Investigation distinguishes lawful hemp from marijuana and states that marijuana over its hemp THC threshold remains illegal. There is no general adult possession allowance in the official materials reviewed. The legal treatment of a hemp-derived product depends on the specific product and Tennessee's separate hemp rules.

Medical access

Tennessee formed a Medical Cannabis Commission to study and prepare proposals, not to oversee an operational patient supply system. A 2024 commission report says it was not responsible for in-state cultivation, processing or distribution to patients. A 2026 enacted law preserved state scheduling restrictions unless the legislature first establishes a marijuana regulatory framework; it did not create patient dispensing. Narrow CBD-related exceptions for certain seizure conditions should not be described as a broad medical marijuana program.

Home cultivation

Tennessee's environmental and agriculture guidance says hemp may be grown under agriculture rules, while marijuana is not legal. Nothing in the reviewed sources allows an adult or medical patient to grow marijuana at home. A commercial hemp permit is different from a personal cannabis home grow.

Buying cannabis

There is no licensed Tennessee marijuana dispensary channel established in the reviewed current official material. Regulated hemp-derived cannabinoid sellers operate under different rules, and a product's appearance or marketing does not turn it into authorized medical marijuana. Proposed medical-cannabis bills are not evidence of operational sales.

Taxes

Because Tennessee has no verified licensed marijuana retail market here, this guide does not quote an adult-use or medical marijuana excise tax. Hemp-derived products may have separate retail and licensing taxes. Rates in proposed medical bills must not be used as current cannabis checkout rates.

Visitors and travel

An out-of-state medical card or legal purchase elsewhere does not create a Tennessee marijuana possession right. Do not transport marijuana across the state border. Check product-specific hemp rules separately if traveling with hemp or CBD; a hemp label alone is not proof of compliance.
