State guide

Texas marijuana laws

Texas has a restricted Compassionate Use Program for prescribed low-THC cannabis. It does not offer general adult-use marijuana sales or a home-grow right.

What still needs checking

  • Current Comptroller healthcare-item tax guidance was directly read; it gives a conditional medicine exemption but no explicit CUP product ruling. CUP-specific tax searches found none. Patient checkout rate intentionally left unquantified.
  • DPS page embeds an old 2020 date despite showing newer qualifying conditions. Enrolled HB 46 and its effective-date history resolve the materially changed low-THC definition; the older State Law Library threshold is superseded.

Possession and use

Possession of marijuana without a valid Texas Compassionate Use Program prescription remains a criminal offense. The exception applies to the low-THC product prescribed to a patient and supplied by a licensed dispensing organization. Since September 1, 2025, Texas's statutory definition of low-THC cannabis has used a maximum of 10 milligrams of THC per dosage unit; the former one-percent-by-weight threshold is outdated. This exception does not create an open adult-use possession limit.

Medical access

CUP requires a permanent Texas resident with an eligible condition to receive a prescription from a physician registered with the program. The prescription is entered in the Compassionate Use Registry of Texas; patients do not receive a conventional state medical marijuana card. A 2025 law expanded listed conditions and product rules, so older summaries should not be used for the current eligibility list.

Home cultivation

Texas DPS explicitly says patients cannot grow their own cannabis. Only licensed dispensing organizations may cultivate plants for low-THC products under CUP. Hemp cultivation has its own licensing framework and is not a patient home-grow route.

Buying cannabis

The registered physician enters the prescription into CURT. A licensed dispensing organization verifies that entry before dispensing, and the patient or legal guardian identifies themselves at pickup. Smoking is excluded from Texas's definition of medical use. There is no lawful adult-use dispensary channel in the cited program.

Taxes

The official sources reviewed do not establish a cannabis-specific patient excise tax for CUP purchases. They describe a controlled prescription and dispensing system rather than an adult-use retail tax structure. Ordinary sales-tax treatment should be checked with the Comptroller for a specific product or transaction before quoting a checkout rate.

Visitors and travel

Texas DPS says CUP is limited to permanent Texas residents and an out-of-state prescription cannot be filled in Texas. An out-of-state medical card therefore does not qualify a visitor. A Texas CUP prescription does not authorize carrying a cannabis product across a state border.
