State guide

Virginia marijuana laws

Virginia permits limited adult possession, home cultivation and unpaid adult sharing. Licensed medical sales operate, while nonmedical retail sales are still illegal as of this check.

What still needs checking

  • The future July 2027 date is the CCA's stated schedule as seen October 2026, not a claim sales are already operational.
  • Current code and CCA agree on two ounces; older one-ounce summaries are superseded.

Possession and use

The current Virginia code allows adults 21 and older to possess up to two ounces of marijuana outside their private residence. The Cannabis Control Authority also describes private residential possession and use, subject to an owner's restrictions. Possession above the public limit brings escalating penalties; public consumption and impaired driving remain illegal.

Medical access

Virginia's medical program allows permanent or temporary Commonwealth residents to receive a written certification from an eligible practitioner for a condition that may benefit from cannabis. A separate state registration card is generally not needed to buy at a licensed medical dispensary. Virginia dispensaries cannot accept out-of-state medical cards or certifications.

Home cultivation

An adult aged 21 or older may grow up to four plants for personal use at their main residence, but a household may never contain more than four plants regardless of resident count. Each plant must be tagged with the cultivator's name, identification number and personal-use notation. Plants must be out of public view and protected from unauthorized access by under-21s. The cited cultivation statute states no additional medical-patient allotment.

Buying cannabis

Medical cannabis is available from licensed pharmaceutical processors or dispensing facilities to eligible certified patients. Virginia's Cannabis Control Authority explicitly says nonmedical sales remain illegal. It currently gives July 1, 2027 as the planned start for retail marijuana, a future date that is not evidence stores are operating today. Unpaid transfer of two ounces or less between adults is allowed only without a reciprocal exchange.

Taxes

There is no legal adult-use retail checkout tax to quote while nonmedical sales are prohibited. The Commonwealth's official oversight report states medical cannabis is exempt from Virginia sales and use tax. Taxes contemplated for a future retail market should not be applied to present patient transactions.

Visitors and travel

Adult visitors are subject to Virginia's two-ounce public possession cap, but they cannot buy nonmedical cannabis from a Virginia retailer now. A visitor seeking medical sales cannot rely on an out-of-state card; the medical program requires a Virginia practitioner certification and Commonwealth residency as described by the Authority. Nothing in these rules permits transporting cannabis across a state border.
