Cannabis law. In plain language.

State guide

Wyoming marijuana laws

Wyoming has not established a general adult-use or medical marijuana program. Marijuana possession and cultivation remain controlled-substance offenses; lawful hemp is a distinct category.

What still needs checking

  • Hemp statute link is a 2024 edition; current hemp amendments should be checked before product-specific publication.
  • Current Title 35 PDF was opened, but exact possession penalties were intentionally omitted to avoid form/weight mistakes.

Possession and use

Wyoming's Title 35 controlled-substances law prohibits unauthorized marijuana possession. It contains penalties that vary by form, weight and prior history, so this guide does not compress them into a single universal sentence. A 2022 proposed Patient Cannabis Act did not by itself change the current law; only enacted statutory text controls.

Medical access

The current statute says a practitioner generally cannot prescribe marijuana or THC, except for drugs receiving final federal FDA approval. That exception is not a state medical cannabis dispensary program. An out-of-state medical card does not give a Wyoming patient registration or marijuana purchase pathway.

Home cultivation

Wyoming Statutes § 35-7-1040 makes knowingly planting, cultivating, harvesting, drying or processing marijuana an offense except where law otherwise permits. No patient or adult personal grow route was found in the reviewed law. Separately, the hemp production statute requires licensing to produce or process hemp.

Buying cannabis

No Wyoming adult-use or medical marijuana retailer is authorized in the current statutes reviewed. The hemp statute permits possession, purchase and sale of qualifying hemp products subject to its exceptions. A hemp seller is not a marijuana dispensary, and an unpassed medical-marijuana bill is not a license.

Taxes

Wyoming has no verified licensed marijuana retail market to which a cannabis excise rate can be attached. Do not use tax rates contemplated in proposed bills. Lawful hemp commerce has its own ordinary business-tax treatment, outside this marijuana guide.

Visitors and travel

An out-of-state adult-use purchase or medical card does not overcome Wyoming's marijuana prohibition. Crossing a state border with marijuana creates an additional federal issue. The hemp statute's allowance for qualifying hemp transportation is not permission to move marijuana.
