Cannabis law. In plain language.

State guide

Wisconsin marijuana laws

Wisconsin has not enacted medical or recreational marijuana legalization. Limited cannabidiol and hemp rules are separate from a marijuana patient or adult-use market.

What still needs checking

  • Wisconsin legislature statute pages returned access errors in the web tool. A 2026 Wisconsin Court of Appeals certification directly quotes the controlled-substance possession text and exceptions, corroborating current DHS and governor status; it is not a final ruling on hemp-proof burdens. Exact penalty language is omitted.
  • Hemp law may change in November 2026; guide does not predict its final effect.

Possession and use

Wisconsin's Department of Health Services states that possessing illegal drugs, including cannabis, violates state law. In a 2026 public letter, the governor said Wisconsin had not enacted medical or recreational marijuana legalization. Some local enforcement policies may vary, but they do not establish a statewide adult possession allowance.

Medical access

There is no operational Wisconsin medical marijuana dispensary program in the reviewed official material. Wisconsin law has a narrow cannabidiol treatment exception and investigational-drug provisions, but these are not broad access to cannabis flower or high-THC products. Proposed medical bills must be distinguished from enacted law.

Home cultivation

Without an adult-use or medical marijuana cultivation authorization, a resident cannot infer a right to grow marijuana at home. The Department of Justice distinguishes regulated hemp by its THC content. Producing hemp and cultivating marijuana are different legal acts; a hemp business pathway is not a personal marijuana grow allowance.

Buying cannabis

Wisconsin has no licensed adult-use or general medical marijuana storefront system in the official sources reviewed. Hemp-derived products are a separate market with product-specific rules. A shop in another state does not create a Wisconsin right to possess what it sells.

Taxes

No Wisconsin marijuana excise or licensed dispensary sales-tax rate is quoted because the state has not enacted those retail markets. The 2025–27 budget analysis discussed a proposed tax structure, but proposed rates cannot be treated as law. Tax on lawful hemp products must be assessed separately.

Visitors and travel

A visitor's out-of-state card or adult-use purchase does not establish a Wisconsin marijuana possession exception. Bringing a marijuana product into Wisconsin also crosses a state line; do not infer permission from the place of purchase. Different federal and state definitions of hemp warrant a product-specific check for hemp goods.
