What still needs checking
- The Legislature's §37-2732 endpoint remains blocked by robots.txt; the current Office of Drug Policy page independently confirms prohibition, but this guide quotes no offense tier or penalty.
- Specific hemp-product legality is outside this marijuana guide and was not inferred from the controlled-substance prohibition.
Possession and use
Idaho's controlled-substance rules treat marijuana possession outside a narrow lawful exception as a criminal matter. No general adult-use amount, decriminalized threshold or state medical card can be inferred from the official materials consulted. Do not interpret another state's purchase receipt or medical card as an Idaho defense. The exact charge and penalty depend on quantity, circumstances and current statute; those details were not verified against the 2026 codification because the Legislature's statute site blocked automated access.
Medical access
Idaho does not operate a state program that registers patients to purchase THC cannabis. The state's enforcement materials distinguish federally lawful hemp or approved medicines from ordinary marijuana; such exceptions do not create a dispensary system. Patients moving from another state should consult their clinician about lawful alternatives before arriving. A medical recommendation or registry card issued in a neighboring state does not turn possession of that state's product into an Idaho-authorized medical transaction.
Home growing
There is no adult-use or medical patient home-grow allowance. Planting even a small number of marijuana plants can trigger controlled-substance law; a private indoor space or personal therapeutic purpose is not a license. Industrial hemp has a separate regulatory framework and should not be confused with marijuana home cultivation. This guide does not state a plant-count penalty because a current, accessible official statutory text could not be confirmed for the 2026 code.
Where to buy
Idaho has no licensed adult-use or medical marijuana retailer network. Stores selling federally compliant hemp products are operating under a different legal category and are not proof that THC marijuana retail sales are lawful. An out-of-state shop's proximity to Idaho or a delivery website's willingness to accept an address does not override Idaho law. Verify any claimed exception directly with the state's responsible regulator before purchasing or possessing a product in Idaho.
Taxes and price
Because there is no licensed Idaho adult-use or medical marijuana market, there is no Idaho marijuana retail excise rate or medical dispensary checkout schedule to quote. Ordinary sales tax on lawful unrelated products is a separate issue and cannot be used to imply a prohibited sale is legal. This guide deliberately omits any tax estimate for an illicit marijuana purchase; a receipt or tax collection by an out-of-state business does not change Idaho possession rules.
Travel and public places
Do not bring marijuana into Idaho from Washington, Oregon, Nevada or another state where it was lawfully bought. Crossing a state border introduces federal concerns, and Idaho's own restrictions apply once inside the state. A vehicle, hotel room or rented home does not become an exempt medical location because a visitor has a foreign card. Do not drive impaired. If traveling with a prescription medicine derived from cannabis, verify the product's precise legal classification and packaging separately.
Sources and remaining checks
We checked the sources below on the date shown above. Rules may have changed since then. Check the current rules before making a decision, and read the remaining questions noted in this guide.
- Idaho Office of Drug Policy: marijuana law. Read 23 Oct 2026; agency legal-classification section says marijuana possession, sale and use are illegal in Idaho. Its separate 2024 ballot-initiative paragraph is historical and was not used as current law.
- Idaho State Police 2024–2028 JAG strategic plan. Read 23 Oct 2026; historical 2024 absence of a medical/adult-use program, corroborated for current use by the Office of Drug Policy's legal-classification section.
