What still needs checking
- The alternate General Assembly full-text endpoint confirms P.A. 104-463's 12 June 2026 effective date and cumulative limits; the older document endpoint returned 502.
- Department of Revenue page contains a November 12 2026 future hemp provision that was not treated as current on October 23.
Possession and use
Illinois residents 21 or older may possess up to 60 grams of flower, 1,000 milligrams of THC in infused products and 10 grams of concentrate. Nonresidents may possess half those amounts: 30 grams, 500 milligrams and five grams respectively. Section 10-10 says the category limits are cumulative; a person must still stay within each applicable limit. Cannabis use remains restricted in public places, vehicles and areas where smoking is prohibited. Private landlords and employers may restrict use.
Medical access
Illinois has a separate medical cannabis patient program for people with qualifying conditions, registration and medical dispensary access. Some patients under 21 can participate with applicable caregiver rules. An out-of-state medical card does not automatically create Illinois medical patient status; nonresident adults 21 or older can buy under adult-use rules. Medical allotment and purchase tracking are separate from the resident adult possession amounts, so cardholders should consult the medical program for their individual limit.
Home growing
Adult-use customers who are not registered medical patients may not grow cannabis at home. Illinois medical patients 21 or older may cultivate up to five plants in an enclosed, locked space, subject to the statute's household and access conditions. A landlord can prohibit cultivation in leased premises. The five-plant rule is a medical privilege, not an adult-use entitlement for every resident, and seeds bought from a store do not themselves grant cultivation permission.
Where to buy
Adults 21 or older may buy at state-licensed adult-use dispensaries after showing identification. The state provides a dispensary locator; check the license and whether a site serves adult use, medical patients or both. Nonresidents face lower possession and purchase quantities. A medical-only facility may have different entry and allotment rules. The current state FAQ reflects the 2026 increased limits, while older PDFs and articles may still quote the prior 30-gram resident limit.
Taxes and price
Illinois applies a cannabis purchaser excise tax of 10% for flower or products at or below 35% THC, 20% for cannabis-infused products and 25% for products above 35% THC. General state and local retail taxes may also apply; the state base sales tax is 6.25%, with local additions. Medical transactions follow distinct rules. The Department of Revenue's tax page includes future-dated hemp changes; those should not be treated as in force before their effective date.
Travel and public places
Keep cannabis within Illinois. Do not carry it into neighboring states even if purchased from an Illinois dispensary, and do not use it on federal property. In a vehicle, cannabis must be secured in a sealed, odor-proof, child-resistant container that is reasonably inaccessible while moving. Driving impaired is prohibited. Consumption is not permitted in public or in a motor vehicle. A dispensary receipt documents a sale, not permission to use in a hotel, park or workplace.
