What still needs checking
- The official current code portal did not expose §35-48-4-11 to the research tool; no exact penalty or unverified exception is asserted.
- A June 2026 Indiana Court of Appeals opinion confirms the operative possession ban. The specific 2026 code section still could not be read from the JavaScript-only portal; no penalty schedule is asserted.
Possession and use
Indiana law does not give adults a legal small-quantity marijuana allowance. A June 2026 Indiana Court of Appeals opinion states that possession remains illegal under Indiana Code §35-48-4-11. Exact offense level can depend on amount, prior convictions and circumstances; this guide does not flatten those into a single penalty. Cannabis products that qualify as lawful hemp are a distinct category and should not be used to infer that ordinary marijuana is legal.
Medical access
Indiana has no state card program that lets qualifying patients buy ordinary THC cannabis from licensed medical dispensaries. Bills considered in 2026 to create or expand cannabis access were introduced but did not become a medical retail system. A medical card issued in Illinois, Michigan or another state is not an Indiana registration, and a doctor's recommendation from elsewhere does not change Indiana's possession rule. People using cannabis therapeutically should discuss lawful Indiana options with a clinician.
Home growing
Indiana does not provide an adult or medical home-growing allowance for marijuana. Growing one or several plants is not made lawful by keeping them inside a private home or asserting personal medical use. Industrial hemp production follows separate licensing and compliance rules. This guide does not quote a cultivation penalty without a current codified-statute read, because the official 2026 code endpoint did not yield readable text in the research tool.
Where to buy
Indiana has no licensed adult-use marijuana stores or comprehensive medical dispensaries. Buying in another state and driving the product home still leaves the buyer subject to Indiana law and federal interstate rules. A hemp retailer is not a marijuana dispensary, and product labeling alone does not establish that a particular item meets Indiana hemp requirements. Do not treat a proposed bill, neighboring state's law or online delivery offer as evidence of an Indiana retail authorization.
Taxes and price
Without a lawful Indiana adult-use or medical marijuana retail market, no state cannabis excise rate or medical dispensary tax applies. Ordinary sales taxes on lawful products such as compliant hemp are a different question and do not legalize marijuana transactions. Proposed tax rates in unpassed cannabis bills have no operative effect. This guide gives no hypothetical checkout price for a marijuana purchase in Indiana.
Travel and public places
Do not bring marijuana into Indiana from a state where it was bought legally. Neither a foreign patient card nor a receipt substitutes for an Indiana legal exception. Interstate transport raises federal concerns, while possession inside Indiana is assessed under Indiana law. Avoid impaired driving and do not assume a hotel room or private vehicle provides a safe exception. Verify the legal classification of any prescription cannabinoid medicine separately rather than applying marijuana rules by analogy.
