What still needs checking
- Official Revisor §21-5706 text was available through the search index but direct fetch returned 400; the guide relies on its prohibition and omits precise offense tiers and narrow defenses requiring full statutory review.
- Absence of a medical program is supported by failed SB 294 and lack of program directory, but should be rechecked if new legislation takes effect.
Possession and use
Kansas has not adopted a general adult-use marijuana possession allowance. Controlled-substance laws apply to ordinary marijuana even when the amount is small or the product was bought lawfully elsewhere. The precise charge depends on current statutes and the facts; this guide does not quote a penalty because the Revisor statute page could not be retrieved through the research tool. Hemp and certain federally approved medicines may be treated differently, but those categories do not establish a broad marijuana possession exemption.
Medical access
Kansas does not issue a medical marijuana patient card or license medical cannabis dispensaries. Senate Bill 294 proposed a medical cannabis act in the 2025–26 session, but the Legislature's bill page marks it 'Died.' A proposal's description is not operative law. A medical card from Missouri, Colorado or another state does not create Kansas patient status. People seeking treatment should discuss available lawful medicines with their clinician rather than assume neighboring-state medical rules travel with them.
Home growing
There is no Kansas adult-use or medical patient allowance to grow marijuana plants at home. A proposed medical cultivation license in an unpassed bill does not apply to private residents or businesses. Industrial hemp is subject to a separate state and federal framework; obtaining a hemp license is not a shortcut to growing marijuana. The 2026 controlled-substance chapter should be consulted before taking any action, because plant-count penalties and exceptions were not confirmed here.
Where to buy
Kansas has no state-licensed adult-use marijuana retailer or medical cannabis dispensary network. A shop offering hemp or CBD products is not thereby a marijuana dispensary, and a dispensary across the border cannot lawfully deliver Kansas legal status with its purchase receipt. Do not rely on SB 294's proposed retailer provisions; the bill died. Where product classification is genuinely uncertain, obtain current agency guidance for that specific product before purchasing rather than extrapolating from another state's label.
Taxes and price
With no enacted Kansas marijuana retail program, no adult-use cannabis excise tax or medical dispensary checkout rate is in force. Any excise or licensing fees proposed in SB 294 never became operative through that bill. Sales tax on lawful hemp or other goods is a separate issue and does not authorize a marijuana sale. This page therefore provides no hypothetical tax percentage or checkout price for a prohibited marijuana transaction.
Travel and public places
Do not bring marijuana into Kansas from a state where it was sold legally. State restrictions apply inside Kansas, and crossing borders raises federal concerns. A medical recommendation or card from another jurisdiction is not a Kansas purchase or possession authorization. Avoid impaired driving, and do not assume a rental home or hotel room creates a patient exception. For lawful prescription medicines, verify the specific product and prescription rules rather than relying on general cannabis labels.
Sources and remaining checks
