Kentucky marijuana laws

Kentucky's medical cannabis program has operating dispensaries as of 2026. Adult-use cannabis remains unauthorized, and patients must follow product, supply and card rules.

What still needs checking

  • The official dispensary directory is dated Oct 16 2026; recheck openings and hours before a trip.
  • Current statutory chapter updated Oct 22 2026; no adult-use authorization or old out-of-state pardon is assumed.

Possession and use

Kentucky protects registered medical patients and caregivers within program limits; it has no general adult-use possession allowance. The medical 30-day supply is defined by regulation as up to 112 grams of raw plant material, 28 grams of concentrate or 3,900 milligrams of THC in infused products, with equivalency rules. The program allows raw material but prohibits consuming it by smoking. A purchase receipt or out-of-state card alone does not replace the Kentucky registration requirements.

Medical access

Kentucky residents with a qualifying condition and practitioner certification can apply for a patient card. A visiting patient may apply for a Kentucky registry card, but Kentucky's official visitor guide says that card is not required to buy from a licensed dispensary. Without a Kentucky visitor card, bring a valid out-of-state medical registry card, another government photo ID and documentation of a Kentucky-qualifying condition. Visiting patients are limited to a 10-day supply. The former conditional pardon for some out-of-state medical purchases was rescinded effective July 1, 2026; it is not a source of current access.

Home growing

Kentucky's patient and caregiver registrations do not allow growing cannabis at home. Cultivation is reserved for licensed medical cannabis businesses. The program also does not create adult-use personal cultivation. Do not assume that possession of raw plant material or seeds grants a right to cultivate. A property owner, landlord or caregiver cannot turn a patient card into a cultivation license; the office's FAQ directly distinguishes patient access from licensed production.

Where to buy

Use the Office of Medical Cannabis's current dispensary directory to find a shop that is open. Kentucky visiting patients may buy without a Kentucky visitor card if they present a valid out-of-state medical registry card, another government photo ID and documentation of a Kentucky-qualifying condition. An approved Kentucky visitor card is an alternative credential. Visiting patients may purchase up to a 10-day supply. Recreational storefront sales are not authorized.

Taxes and price

The Office of Medical Cannabis says qualifying medical cannabis sales are exempt from Kentucky sales and use tax, and Kentucky does not levy a separate medical cannabis excise tax. This concerns authorized patient purchases; other items or nonmedical transactions cannot be assigned the same treatment automatically. Dispensaries set product prices, so check an itemized receipt rather than infer a statewide final price. There is no adult-use cannabis tax to quote because Kentucky has no adult-use market.

Travel and public places

Do not bring cannabis from another state into Kentucky or take Kentucky purchases across a border. A visiting patient should buy from a licensed Kentucky dispensary after presenting the documents required by the state's visitor rule; Kentucky registration is optional for that purchase. The former conditional pardon for certain out-of-state purchases ended July 1, 2026. Do not smoke raw medical flower or drive impaired.
