Possession and use
Louisiana has no general adult-use possession allowance in the medical program materials reviewed. A valid medical recommendation is the core protection; do not treat the patient flower purchase limit as a public adult-use allowance. Use in public and driving while impaired remain outside the protected medical pathway.
Medical access
Louisiana law permits a visiting qualifying patient with an active medical card from another US jurisdiction to buy from a permitted retailer. Section 40:1046.1 requires the card, a valid government photo ID and a signed state form identifying the qualifying condition; retailer staff review state tracking records before dispensing. Louisiana patients use an authorized clinician recommendation. The health department lists a 71-gram flower limit per 14 days.
The underlying statute names authorized clinicians including physicians, nurse practitioners with prescriptive authority and medical psychologists meeting state licensing requirements. A recommendation is not interchangeable with an ordinary prescription or an out-of-state card. The recommended form and amount must be respected by the Louisiana retailer.
Home cultivation
The reviewed health department page describes licensed manufacturing and retail distribution, not a general right for patients or adults to grow at home. Treat personal cultivation as unauthorized unless a directly applicable statute or rule establishes an exception.
Buying legally
Use a Louisiana licensed medical marijuana retailer; the health department lists the retailers and says they dispense approved dosage forms. The state has no adult-use storefront system under these reviewed materials. Product taken from another state is not shown to be an authorized source for a Louisiana retailer.
State law requires recommended therapeutic marijuana to be sold in person by a Louisiana-permitted marijuana retailer. It also directs the department to prevent product being sold from, produced from, obtained from or transferred to a location outside Louisiana. This is a closed in-state medical supply chain.
Taxes
Louisiana Revised Statutes section 47:305.2(B)(11) exempts marijuana recommended for therapeutic use by qualified patients from sales and use tax imposed by any taxing authority. The qualifying marijuana product therefore has no state, parish or city sales tax added at checkout.
The exemption is specifically for therapeutic marijuana sold to a qualified patient under section 40:1046. It does not automatically cover hemp products, separately priced accessories or nonqualifying purchases. Ask the retailer how other items and charges on the receipt are taxed.
Travel and transport
The department notes that retailers may not deliver to addresses outside Louisiana. Visiting-patient access, where applicable, is a purchase rule, not permission to carry marijuana over a state border. Keep products within Louisiana and avoid federal property.
