Possession and use
A person 21 or older may hold 2.5 ounces of cannabis or a combination of cannabis and concentrate, with no more than 10 grams of concentrate. Public consumption is prohibited; private-property owners may also forbid use. The amount is a possession ceiling, not a guarantee that every form or setting is permitted.
Medical access
Maine runs a separate medical program. A visiting patient may use an eligible home-state medical credential if that state appears on OCP's approved list and authorizes its use in Maine. OCP says the photo ID must come from the same jurisdiction as the credential. Medical and adult-use product are dispensed through separate facilities.
The Office of Cannabis Policy maintains a specific visiting-patient state list and says it can change. Travellers should check that list and bring both the qualifying credential and matching-jurisdiction photo ID. A Maine medical transaction is distinct from shopping as a 21-plus adult-use consumer, with different tax and product rules.
Home cultivation
An adult 21 or older may grow up to six mature plants, 12 immature plants and unlimited seedlings for personal adult use. Maine sets this allowance per adult grower, rather than one statewide household plant maximum. Plants must be screened from public ways, mature and immature plants tagged, and access by people under 21 reasonably restricted. Local parcel rules may apply, but must preserve the statutory allowance for each domiciled adult.
Medical cultivation has a separate patient allowance of six mature plants, 12 immature plants and unlimited seedlings, whether the qualifying patient grows or designates an eligible caregiver. Qualifying patients in one household who grow their own plants may share at most two cultivation areas. Do not add the adult and medical counts for one person's grow.
Buying legally
Adults 21 and over can purchase from adult-use cannabis stores. Verify the establishment is licensed for adult-use retail, as a medical-only location does not serve the same customer class. Purchase and possession limits still apply after leaving the store.
The 2.5-ounce possession limit also matters after a purchase. A buyer cannot make several legal transactions and then carry more than the lawful total. Maine permits free transfer to another adult within the same capped amount, but that does not authorize an unlicensed sale.
Taxes
Maine Revenue Services lists a 14% sales-tax rate for adult-use cannabis effective January 1, 2026, replacing 10%. Medical cannabis generally has a 5.5% sales-tax rate, while prepared food containing medical cannabis is listed at 8%. These are retail rates, and product type matters.
Travel and transport
The Office of Cannabis Policy says leaving Maine with cannabis, medical or recreational, is illegal. Do not cross state lines or approach a border crossing carrying it, and do not mail it. Use in a vehicle on a public way is prohibited for driver and passengers.
