Cannabis law. In plain language.

State guide

Maryland marijuana laws

Maryland has licensed adult-use sales for people 21 and older alongside a registered medical program.

Possession and use

Adults 21 and older may possess a personal-use amount of up to 1.5 ounces of flower, 12 grams of concentrate, or cannabis products containing no more than 750 milligrams of THC. Amounts above the personal-use threshold can trigger civil or criminal consequences. Consumption belongs on private property where the owner allows it.

Maryland also identifies a larger civil-use amount of up to 2.5 ounces, but civil treatment is not the same as being within the protected 1.5-ounce personal-use amount. Concentrate and edible products have separate thresholds, so comparing only package weight can misstate whether a purchase fits the law.

Medical access

Medical purchasing is for registered and certified Maryland patients and caregivers. The administration expressly says an out-of-state medical card does not provide Maryland medical purchasing access; visitors aged 21 or older may instead buy adult-use cannabis with government photo identification. The medical pathway has different allotments and access rules.

A Maryland patient and caregiver must be registered and certified within the state's system. The administration's FAQ explicitly answers the reciprocity question in the negative for medical checkout. A visitor who is 21 or older can use the adult-use market but gets its smaller limits and adult-use tax treatment.

Home cultivation

An adult 21 or older may grow two plants in a home out of public view, with a two-plant household ceiling. A registered medical patient may grow two additional plants, but no residence may exceed four. Landlords and property owners may prohibit cultivation.

Buying legally

Buy from a licensed dispensary and bring a government-issued photo ID showing age 21 or older. The administration says the legal transaction limit is the personal-use amount. The retail system is operational; there is no need to infer availability merely from legalization.

Taxes

Maryland Tax-General section 11-104(k) sets the cannabis sales and use tax at 12% for fiscal 2026 and later. The Comptroller's tax alert dates the increase from 9% to 12% to July 1, 2025. Medical cannabis transactions may have a different exemption; confirm the transaction type rather than applying the adult-use rate to every patient purchase.

Travel and transport

Maryland says neither entering nor leaving the state with medical or adult-use cannabis is permitted, and mailing it across borders is illegal. In a car, carry it in the trunk or sealed packaging, and do not consume in a moving vehicle. Federal property remains off limits.

The state cautions that cannabis remains illegal on federal property, including national parks and military sites. For vehicle travel within Maryland, the administration recommends the trunk or a sealed package. Those in-state storage instructions do not weaken its rule against carrying medical or adult-use product across a state line.
