State guide

New Hampshire marijuana laws

New Hampshire allows registered therapeutic cannabis and recognizes qualified visiting patients, but not general adult-use sales.

Possession and use

A qualifying patient may possess up to two ounces of usable cannabis under RSA 126-X. Outside that program, possession of up to three-quarters of an ounce of marijuana remains a violation subject to a fine under RSA 318-B:2-c. This reduced penalty is not adult-use legalization or a lawful retail purchasing pathway.

RSA 318-B:2-c treats possession of up to three-quarters of an ounce of nonmedical marijuana as a violation subject to a civil fine, and provides separate small-hashish and regulated infused-product provisions. A violation still means the conduct is unlawful. The therapeutic two-ounce protection applies only when the patient follows RSA 126-X.

Medical access

A visitor with a qualifying medical credential from another US jurisdiction or Canada can be a visiting qualifying patient under the statute. Rules allow an alternative treatment center to dispense to a verified visitor, with no more than two ounces in ten days. Check the center's accepted documents before travel.

The therapeutic statute recognizes an out-of-state or Canadian registry card for a visiting qualifying patient, while the rules require a center to verify and record the credential. Visitors may buy from an alternative treatment center, but the statute forbids buying from a New Hampshire patient or caregiver and forbids personal cultivation.

Home cultivation

RSA 126-X expressly excludes cultivation by patients, caregivers and visiting patients from its protected therapeutic-use definition. This means the card does not authorize home growing. Licensed alternative treatment centers are the regulated source.

Buying legally

Therapeutic cannabis is dispensed at an alternative treatment center after the program verifies a state patient or visiting-patient credential. The rules specify a two-ounce usable cannabis limit in a ten-day period. No general 21-plus adult-use storefront authorization appeared in the reviewed law.

The two-ounce-in-ten-days center dispensing limit is not the same as permission to possess more than two ounces at once. A patient should carry the registry card when outside home; the rules describe a fine where a qualifying patient or caregiver cannot present the required card.

Taxes

New Hampshire has no general sales and use tax, according to its Department of Revenue Administration. That establishes the ordinary sales-tax position; it is not a promise that every program charge or retailer fee is absent. No separate cannabis-specific checkout tax was established in the therapeutic sources reviewed, so this guide does not invent an excise percentage or final price.

Travel and transport

New Hampshire's visiting-patient recognition permits eligible in-state medical access; it does not authorize carrying cannabis into New Hampshire from another state. The statute also bars a visitor from cultivating or buying from another patient or caregiver. Keep purchases within the state.
