How the tax works
Florida law exempts qualifying medical marijuana and defined marijuana delivery devices from state sales tax. Because the county discretionary surtax applies to taxable sales, a qualifying medical marijuana product does not need a county tax rate either. On a $100 medical marijuana product sale, this estimate adds $0 tax and shows $100 before other charges.
This tool covers only a lawful medical marijuana product sold under Florida's program to a qualified patient or caregiver. It does not classify delivery devices or unrelated accessories for you, even though a device meeting the legal definition can also be exempt. Confirm product status, eligibility and any store charge with the medical marijuana treatment center.
Use a pretax retail price after discounts, excluding separately stated taxes. Tax-inclusive advertised prices must be converted to a pretax price first. Store fees, delivery charges and receipt rounding can change the amount owed; this estimate does not resolve their tax treatment.
