What still needs checking
- The current Mass. General Laws c.94G section 7(a), amended effective April 19, 2026, confirms two ounces outside the home and ten ounces in the primary residence.
Possession and use
The commission's consumer rules permit adults 21 and over to possess up to two ounces in public and store up to ten ounces at home; amounts above two ounces at home must be secured. Public consumption and driving impaired are prohibited. The medical program has a distinct 60-day supply rule.
The commission's current Know the Laws page describes a two-ounce public carry ceiling and ten ounces in the home. It separately says marijuana over two ounces in the home should be locked. Readers should check the amount they carry away from a retailer against both purchase rules and the possession ceiling.
Medical access
Registered qualifying patients must receive a Massachusetts medical certification. The commission defines a standard 60-day supply as ten ounces, with a clinician able to recommend a different amount. An out-of-state card alone does not establish Massachusetts program enrollment under the reviewed commission materials.
A qualifying patient must carry the Massachusetts program registration card while possessing marijuana for medical use. The commission's patient guidance defines a standard 60-day supply as ten ounces. Patients who qualify for hardship cultivation follow a registration process rather than assuming that patient status alone lifts every adult cultivation rule.
Home cultivation
Adults may grow six plants at a primary residence, capped at 12 if two or more adults live there. Plants must be secured and not visible from a public place. A landlord may restrict cultivation. The commission describes additional medical home cultivation pathways and a hardship registration.
Buying legally
Licensed adult-use retailers serve customers 21 and over after ID checks; medical treatment centers serve qualifying registered patients. Check that a shop has the right license before visiting. Massachusetts allows local restrictions on where businesses operate, so availability varies by town.
Taxes
The Department of Revenue lists a 10.75% marijuana retail excise and 6.25% state sales tax on adult-use sales. A city or town may also adopt a local option tax up to 3%. Registered medical sales have different tax treatment and should not be priced as adult-use sales.
The 10.75% excise and 6.25% state sales tax are separate levies on adult-use retail sales. A municipality may add up to 3%, bringing the combined statutory rates to as much as 20% in a participating locality. That calculation excludes the shelf price and any other lawful charges.
Travel and transport
Keep purchases within Massachusetts. A state medical card or adult-use receipt does not grant federal permission to move cannabis between states. Do not drive impaired or consume in public; follow the commission's transport and property-use rules.
