What still needs checking
- The six-ounce/60-gram figure is a purchase allotment, not presented as a general possession ceiling.
Possession and use
West Virginia's medical program permits qualified registered patients to hold and use program products. The Office of Medical Cannabis says patients may purchase up to six ounces of flower or 60 grams of concentrate, or an equivalent mix, in a rolling 30-day period unless their physician sets another limit. This purchase allotment is not a blanket public-possession limit for all adults.
Medical access
A patient needs a certification from a registered physician and an approved West Virginia medical cannabis identification card. The application requires proof of West Virginia residency, identification and supporting documents. Products may be bought only through licensed operational dispensaries; the program allows specific dosage forms and prohibits smoking by combustion.
Home cultivation
The Office of Medical Cannabis says growing medical cannabis without a grower or processor permit is unlawful. Patient card status does not grant home cultivation. The state's permitted commercial supply chain is separate from a resident's medical purchase right.
Buying cannabis
Operational licensed dispensaries may sell to cardholding patients or their registered caregivers after the physician-certification and card process. The Office publishes a dispensary list for locations. Unlicensed purchases are outside the state medical system, and this guide found no adult-use storefront framework.
Taxes
West Virginia imposes a 10% privilege tax on medical cannabis dispensaries' gross receipts. The Tax Division says it must not be shown as a separate charge on a patient invoice. This is a business tax; treating it as a 10% patient checkout line would misstate the rule.
Visitors and travel
The Office of Medical Cannabis says licensed patients and caregivers are prohibited from traveling outside West Virginia with cannabis products. Its patient registration asks for West Virginia residency, so a visitor cannot simply use another state's card at a West Virginia dispensary. Driving while impaired remains illegal for patients.
