State guide

Delaware marijuana laws

Delaware permits adult possession and licensed adult-use sales, alongside a medical marijuana program. Home growing remains prohibited, including for registered patients.

What still needs checking

  • The FAQ has a stale prediction for adult-use openings; the dispensary directory was used for operational status.
  • No particular store's stock, hours or visitor approval was independently verified.

Possession and use

Adults 21 or older may possess a personal-use quantity, generally up to one ounce of leaf marijuana or the statutory equivalent of other products. Public consumption is prohibited, and use is not allowed in a moving vehicle. Medical patients operate under a separate program with their own purchase allotment. Do not infer that legalization of possession permits an unlicensed sale, public use or a larger quantity because a retailer sells larger packages.

Medical access

Delaware residents with qualifying conditions can apply for a medical marijuana card. The Office of the Marijuana Commissioner also describes a visiting-patient application for qualifying out-of-state patients; the applicant must follow Delaware's process rather than merely show a foreign card at a counter. Medical purchase limits are up to three ounces every 14 days and six ounces in a month. Patient eligibility, qualifying documentation and caregiver rules should be checked before travel.

Home growing

Delaware's adult-use law does not allow home cultivation. The medical program also does not grant patients or caregivers a general right to grow at home. Obtain products through authorized suppliers instead of assuming a small private garden is protected. A business cultivation license is a separate regulatory permission and is not interchangeable with a patient card or adult possession allowance.

Where to buy

Adult-use dispensaries are operating according to the commission's current dispensary directory. Use that directory to confirm a licensed location and whether it serves adult-use or medical customers; an earlier FAQ still predicts adult sales in 2025 and is not reliable evidence of current opening status. Medical patients should use authorized compassion centers and bring their Delaware registration or approved visitor credentials. Retail access may vary by location and inventory.

Taxes and price

Delaware law imposes a 15% tax on adult-use retail marijuana sales. Medical marijuana sales are treated separately and are exempt from that adult-use marijuana tax. The statutory tax describes the retailer's obligation and may appear in final pricing; check the receipt for applicable charges rather than assuming a uniform displayed shelf price. No county-specific or product-specific final checkout total is asserted here.

Travel and public places

Do not carry Delaware-purchased cannabis into another state. A Delaware adult-use purchase does not create federal interstate permission, and medical visitor status does not permit bringing a personal supply over state lines. Avoid using in public or in a vehicle, and do not drive impaired. Check hotels and private-property rules before use. Visitors who qualify for the medical program still need to use Delaware's application and licensed supply chain.
